He disclosed that a detailed meeting was held with the Advocate General to finalise procedural aspects and ensure timely submission.Emphasising the urgency, Sarma warned that failure to file the chargesheet before December 18 could make the accused, currently in judicial custody, eligible for default bail.Reaffirming the government’s stand, the Chief Minister stated that Zubeen Garg’s death has been conclusively established as a case of murder. He recalled that as early as the third day of the SIT investigation — which commenced on September 23 — the state government had officially classified the incident as murder.During the ongoing Assembly session on November 25, Sarma had informed the House that all accused have been booked under relevant sections of the Bharatiya Nyaya Sanhita (BNS), including Sections 61 (criminal conspiracy), 105 (culpable homicide not amounting to murder), and 106 (causing death by negligence). The state has also moved the Gauhati High Court to add Section 103 (punishment for murder, equivalent to the erstwhile IPC Section 302) to the charges.“Initial findings clearly point to murder rather than mere negligence. Without Section 103, the accused could have obtained bail,” Sarma told the Assembly.The Chief Minister expressed full confidence in the SIT’s work, describing the investigation as one that uncovered facts previously unknown in the state. “One individual directly committed the act, while others provided assistance. The word ‘murder’ is now formally part of the official record,” he said.He further assured that the filing of the chargesheet will not mark the end of the probe. “The investigation will continue even after the chargesheet is submitted to ensure every person involved is identified and brought to justice.
