"Guwahati: In a major development in the case related to the death of renowned singer Zubeen Garg, the District and Sessions Judge Court, Kamrup (M) on Friday rejected the bail application of accused Amritprabha Mahanta. The court also denied bail to Zubeen Garg"s two personal security officers (PSOs), citing the nature of the evidence placed on record.Advertisment All the accused were produced before the court through video conferencing. The hearing witnessed intense arguments between the prosecution and the defence. While the defence counsel contended that there was no material to establish a case of murder, the prosecution strongly opposed the bail pleas, relying on the evidence and materials collected during the course of investigation. After hearing both sides, the court rejected the bail applications, observing that the available evidence did not justify grant of bail at this stage. Court Observations and Prosecution Stand According to submissions made before the court, Amritprabha Mahanta was allegedly part of the conspiracy, which became the primary ground for strong opposition to her bail plea. Though the detailed order copy is yet to be received, the court"s observations during the proceedings indicated that her alleged role in the conspiracy weighed heavily against her. It was also brought on record that Zubeen Garg"s two PSOs had allegedly kept a huge sum of money in their personal bank accounts with bad intention, amounting to criminal breach of trust and misappropriation of funds. The prosecution argued that had they been innocent, they would have informed Zubeen Garg"s family about the money, which they failed to do. The defence further filed three petitions seeking materials related to a Singapore-linked incident. The prosecution opposed the plea, arguing that there was no connection between the Singapore-related matter and the case registered in Assam, and that it was the responsibility of the defence to manage such materials. Emotional Statement by Zubeen Garg"s Wife Following the hearing, Zubeen Garg"s wife, Garima Saikia Garg, speaking to the media outside the court, broke down emotionally and made a strong appeal for justice. “They should not be granted bail until these demons are punished. They must receive strict punishment,” she said. She further added: “Zubeen treated everyone like his own family and brought them close to us. It was only after his death that I recognised the real faces behind them.”“Considering them as family was our biggest mistake.”“The people of Assam are my strength and courage, and it is the people of Assam who will ensure justice for Zubeen.” Statement from the Prosecution Side Advocate Ziaul Kamar, appearing in connection with the case, stated that the outcome was not an individual success but the result of collective effort. He said that although he argued inside the court, it was the legal team"s extensive analysis and hard work, along with cooperation from the police, that led to the strong presentation of the case. He thanked the investigating team for providing necessary feedback whenever sought. He further stated that, based on the court"s observations, Amritprabha Mahanta was found to be part of the conspiracy, which was a key reason behind the rejection of her bail plea. He also reiterated that the PSOs" actions regarding the alleged money misappropriation established their involvement in criminal breach of trust. Next Dates and Related Pleas The court has fixed February 13 as the next date of hearing in the case. Based on the evidence placed on record against the three accused, their bail pleas were rejected.
