He was booked under the stringent National Security Act (NSA). The court also ordered to scrap the NSA charges on the MLA.

A division bench comprising Justice Kalyan Rai Surana and Justice Suresh Majumdar passed the order, setting aside the detention imposed on the Dhing MLA.

Aminul Islam was arrested in April for his alleged remarks on the Pahalgam terror attack. While he was able to attain bail on the case, he was later detained under the provisions of the National Security Act (NSA). His detention came on the same day he was granted bail.

He was accused of making controversial remarks on the terror attack that killed 26 civilians on April 22 and accused Prime Minister Narendra Modi of fueling it.

The Nagaon Police arrested him on April 24 and lodged him in the Nagaon Central Jail.

Earlier this month, the AIUDF announced that while they had planned to contest 35 seats in the Assam Assembly elections, Aminul Islam would contest from jail itself.
