The chargesheet, spanning nearly 2,500 pages, pertains to case number 18/2025 and outlines the legal provisions invoked under the Bharatiya Nyaya Sanhita (BNS), 2023, India’s updated criminal code that replaces and revises several sections of the former Indian Penal Code.

According to the charge sheet, Siddharth Sharma, Shyamkanu Mahanta, Amritprabha, and Shekharjyoti have been reportedly booked under Section 103 of the BNS, which deals with abetment of murder, indicating their alleged role in facilitating or encouraging the act. Sandeepan Garg has been charged under Section 105, pertaining to culpable homicide not amounting to murder, suggesting involvement in causing death with knowledge or intent to harm but without full premeditation required for murder.

Additionally, two bodyguards have been implicated for criminal breach of trust, pointing to the misuse of professional trust. The CID has invoked Section 316 against Nandeswar Bora and Paresh Baishya, highlighting their direct involvement in causing death through acts committed with knowledge or intention that such acts could be fatal.

The charge sheet has been submitted to the court this morning with previously seized materials, including Zubeen Garg’s mobile phone, medicines, and a suitcase, all of which remain in the custody of the SIT. While the charge sheet has been officially filed, the likelihood of it being made public immediately is low. Legal experts, including Munnaprasad Gupta, are expected to comment on the contents once the official proceedings begin.

Due to court holidays over the weekend, authentic copies for public or media access may only be available on Monday. The filing marks a significant step in the investigation, clarifying the roles of each accused and bringing the case closer to judicial scrutiny, with the provisions of the Bharatiya Nyaya Sanhita forming the legal basis for the charges.
